Terms and Conditions

Glossary of terminology and vocabulary used in this agreement:

– “We,” “Us,” “Our” refers to us, Everlong Preparedness LLC.
– “You,” “student,” “participant,” and “candidate” refer to the enrollee, meaning the person who enrolled to take the class, course, and services.
– “Payment Platform,” “Payment Gateway,” and “Payment Processor” refer to the business and financial institutions/organizations for which we have agreements and contracts for the utilization of their expertise and services on the processing of charges and payments.
– “Venues,” “Place,” and “Site” refer to the locations, public or private, we are utilizing for our training classes, workshops, seminars, and any other services we may offer.
– “Rules & Regulations” refers to the list of rules and regulations displayed for each class, course, event, and service we offer within our business; its content and terms depend on individual services and product types.
– “Client(s)” refers to the enrollee, business partners, and general customers doing business with us.
– “Customer (s)” refers to anyone utilizing and paying for our services.

This privacy notice for Everlong Preparedness LLC (“we,” “us,” or “our “), describes how and why we might collect, store, use, and/or share (“process“) your information when you use our services (“Services“), such as when you:

By registering, signing up, contracting us, or purchasing our services and products, you agree to the Terms and Conditions bellow, Privacy Policy, Cancelation and Reschedule terms, and to the Rules and Regulations pertaining to the product or services you are purchasing or signing up for.

Please read the entire “Rules & Regulations” document related to the service you are requesting or purchasing and read this document of Terms and Conditions in full. Once you complete your order, enrollment, and payment with us, you agree with all Rules & Regulations and accept the contract terms established here contained in the Terms and Conditions document. You are legally bound by those terms.

1- Personal, sensitive information and image of customers and business partners:

2- Payments and Financial Terms
• False Financial Disputes, Claims and Chargeback:
Clients that open bank/credit disputes filing false claims of “no authorized transaction” and any other claim not true will not be taken lightly. We will appeal false claims within the financial institution and have our payment gateway partner’s support, which provides advanced security information that identifies your IP address, information, region, and other crucial details that prove the transaction is legitimate. In an attempt to make sure our customer was not mistaken when they made a claim, we will also send an email alert related to the claim containing informative details on the transaction and how it appears on the client bank/financial statement for easy identification, giving the client a chance to cancel the supposed claim before our counterclaim that will be initiated within 72h counting from the hour and date of the email alert sent before we proceed to avoid what could lead to marking the clients account as a red flag to your financial institution, other institutions, and merchants.
– Participants who are unsatisfied with the refund policy and attempt to undermine our policy by opening false claims with their financial institutions won’t receive an email alert from us. The claim will be escalated to our payments processor and counterclaimed with the client’s financial institution immediately.
If necessary, it will be escalated for legal procedures and collections.

3- Enrollment:
When registering as a new user, each candidate must use a unique email address to enroll in the courses and classes. Two or more participants using the same email address for enrollment are prohibited. Suppose you have previously used an email address for other classes and courses with us or the organization for which you are obtaining the certification. In that case, you may continue using the same email address as long as only one user is registered to this email address. Follow these instructions to avoid experiencing certification and course progress issues, leading to cancelations or lost information.
We do not accept walk-ins. All registration must be done online.

4- Cancellation and Rescheduling.
Please, refer to our Cancellation and Reschedule Terms.

5- Usage of materials and our image:

The use, replication, and alteration of any information from our platform, site, marketing, contracts, agreements, and materials (formulated by our business or utilized by us from direct third parties) by third parties in general, including our clients, is explicitly prohibited and may only be permitted upon a request to use and only if we approve such request in writing.

Sharing our platform address, general information about services, site, publications, marketing, contact, and social media accounts is authorized if it is not altered in any form and cites us as a reference.

All equipment we offer for use in class and training is only available at the location, date, and time estimated, and all material belongs to us. Participants are not authorized to modify, misuse, keep, or take out of the supervision of the instructor/staff any material pertaining to us or the venue in use.

6- Personal Conduct, Safety, Property and Responsibility:

 

• Disruptive behavior and damages:

Disruptive and disrespectful behavior will not be tolerated in any circumstance. 

Please behave adequately in a respectful manner toward staff, instructors, and other participants. Actions and behavior considered disruptive, such as but not limited to derogatory remarks or language, altered behavior that disrupts the class progress and impairs the quality of the training in general, refusal to follow the Rules & Regulations pre-established on course signup and threatening and aggressive behavior towards others (including exposure of weapons to public view) will be treated as such and the instructor may request you to leave the classroom, event, and business location; if necessary, security or other higher authority will be asked to assist. Suppose the disruptor causes any injuries to others or damage to material and location. In that case, legal procedures will be taken, and any financial burdens will be the responsibility of the disruptor.

• Accommodations:

We are not responsible for participants’ injuries at the site of the training resulting from carelessness and disregarding the instructors’ instructions or the dismissal of established rules. Suppose you have any medical limitations or conditions that need extra attention or modification of training and class to meet your needs and prevent injuries adequately. In that case, you must contact us in writing within a reasonable time to arrange the accommodation. We reserve the right to reschedule the participant for a new date/location to meet the accommodations needed or cancel if the accommodations are beyond the possibilities, such as a change of site structures, curriculum requirements for certification, and others not listed here.

• Personal Items damage, loss, or missing:
We are not responsible for any damage to cars or other means of transportation the participants utilized to arrive at and park at the course site or surrounding areas.

Keep your belongings always under your supervision. Everlong Preparedness is not responsible for any personal belongings left unattended in class.

By registering, signing up, contracting us, or purchasing our services and products, you agree to the Terms and Conditions above, Privacy Policy, Cancelation and Reschedule terms, and to the Rules and Regulations pertaining to the product or services you are purchasing or signing up for.
